Changes Coming For Data Centers In Virginia (Virginia Senate Bill 268)

The data center market is becoming increasingly competitive and demand for data warehousing is high; as a result Virginia taxing jurisdictions have become aware of the business value and the tax revenue that can be generated from these facilities. The Virginia Senate Bill 268 came into effect the past July 1st, 2018 which creates a specific classification for data centers valuation purposes. The SB268 states “The classification specifies that the computer equipment and peripherals shall be valued by means of a percentage or percentages of original cost or by any other method that reasonably may be expected to determine fair market value.” Previously, computer equipment and peripherals used in a data center did not have a separate classification for valuation purposes, data center owners main goal is to ensure that the valuation method used in the region for property tax purposes result in fair assessment of these properties. As demand for data center grows, the need to expand to locations where this facilities can find energy, water, space and many other competitive features will increase as well; the Virginia area is a viable region for future growth.
